Coach driver agent agreement

  1. Purpose
    This Agreement sets out the terms and conditions under which the Coach Driver may receive a commission for referring tour groups to the Lakeland Queen Cruises.
  2. Commission Entitlement
    1. The Coach Driver shall receive a commission of twenty percent (20%) of the cruise price actually received by the Company from any referred tour group.
    2. Commission is only payable once the Company has received 100% full payment from the referred customers.
    3. No commission is payable for cancelled or unpaid bookings.
  3. Passenger Confirmation
    1. The Coach Driver must confirm the final number of passengers directly with the Manager on Duty of the vessel prior to cruise departure.
    2. Commission will be calculated solely based on the passenger count verified and recorded by the Manager on Duty.
  4. Commission Payment Terms
    1. Commission shall be paid fourteen (14) days after full payment is received from the referred group.
    2. Payments will be made to the bank account provided by the Coach Driver.
    3. The Company may delay or withhold payment if discrepancies arise regarding passenger numbers or booking details.
  5. Independent Contractor and Tax Obligations
    1. The Coach Driver acts as an independent contractor, not an employee, agent, or partner of the Company.
    2. The Coach Driver is solely responsible for their own tax obligations, including but not limited to income tax, GST, or any other statutory levies.
    3. The Company is not required to withhold or remit taxes on behalf of the Coach Driver.
  6. No Legal Relationship Created
    1. Nothing in this Agreement creates an employment, agency, or partnership relationship.
    2. The Coach Driver has no authority to bind or represent the Company in any manner.
  7. Liability and Indemnity
    1. The Company shall not be held liable for any losses, damages, or claims arising from the Coach Driver’s actions or omissions.
    2. The Coach Driver agrees to indemnify and hold the Company harmless from any claims or liabilities arising from their tax obligations or breach of this Agreement.
  8. Amendments
    1. The Company may amend the terms of this Agreement at its sole discretion, with notice provided to the Coach Driver.
  9. Acceptance of Terms
    1. By signing this Agreement, both parties confirm their acceptance of the terms and conditions contained herein.
